1. ELIGIBILITY

- Have a valid PAN card and proof of identity/address as prescribed under KYC norms.
- Be legally capable of entering into a binding contract under the Indian Contract Act, 1872.
2. KYC COMPLIANCE
We comply with the RBI's Know Your Customer (KYC) guidelines. You agree to submit documents for identity and address verification, and any other documents we may request as per applicable law.
3. LOAN PRODUCTS AND CREDIT SERVICES
Our offerings may include (not limited to):

- Business Loans
- Consumer Finance
All loans are sanctioned subject to internal risk assessment, credit appraisal, and in accordance with RBI norms. Loan disbursement and repayment terms will be set out in the Loan Agreement signed between the Company and the borrower.
4. INTEREST RATES, FEES & CHARGES
Interest rates and all applicable charges (processing fees, prepayment charges, penalties, etc.) will be transparently disclosed in the Loan Agreement and/or sanction letter. We adhere to RBI's Fair Practices Code.
Interest is computed using the method described in the Loan Agreement. Charges are subject to change based on RBI directives or company policies.
5. REPAYMENT OBLIGATIONS
You are required to:
- Repay the loan as per the repayment method set out in the Loan Agreement along with applicable interest and charges on or before the due dates.
- Maintain sufficient balance in your bank account for auto-debit instructions (if applicable).
- Pay late payment penalties in the event of default or delay.
- Loan defaults may result in legal action, recovery proceedings, and reporting to credit bureaus such as CIBIL/Equifax/CRIF etc.
6. USE OF SERVICES
You agree not to use our Services for:
- Money laundering, fraud, or unlawful purposes.
- Submitting false or misleading information.
- Misuse of our Services can result in termination and legal recourse.
7. COMMUNICATION AND CONSENT
By registering with us or applying for any loan, you consent to receive communication via SMS, email, WhatsApp, phone calls, or push notifications regarding your account, promotional offers, or regulatory updates, in accordance with TRAI regulations.
8. DATA PROTECTION AND PRIVACY
We are committed to protecting your personal data as per applicable laws including the Information Technology Act, 2000, and RBI guidelines on digital lending and data privacy. Refer to our Privacy Policy for full details.
9. INDEMNITY
You agree to indemnify, save, and hold Mount Shikhar Financial Services Limited, its affiliates, contractors, employees, officers, directors, agents and its third party associates, licensors, and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to your use or misuse of the services or of the Website, any violation by you of these Terms and Conditions, or any breach of the representations, warranties, and covenants made by you herein.
10. DISCLAIMER OF WARRANTIES

- There is a breach in the above mentioned 'Terms' or the Loan Agreement.
- Required information is not provided or is found to be fraudulent.
- Required under law or instruction from regulatory authorities.
13. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of relevant city/state.

We reserve the right to update or modify these Terms in compliance with applicable legal or regulatory changes. Such changes will be published on our website and will be effective immediately unless stated otherwise.

16. FORCE MAJEURE
The various commitments outlined and made by the Company shall be applicable under the normal operating environment. In the event of any Force Majeure circumstances, the Company may not be able to fulfill the objectives under the FPC to the entire satisfaction of the borrowers, the stakeholders and the public in general.
